THIS TERMS OF USE AGREEMENT (the "Agreement") constitutes a legally binding agreement by and between TAMEZ LABS, LLC, a limited liability company organized under the laws of the State of Texas (doing business as "Loveable Design") and the client, whether personally or on behalf of an entity ("Client"), with regard to access and use of Loveable Design's website: loveable.design (the "Website"), design subscription services, and any other media form, channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the "Services").

By accessing the Website or purchasing a subscription, Client agrees to be bound by all of the terms, conditions, and obligations contained herein. Failure to agree and adhere to all of the terms, conditions, and obligations contained herein results in the express prohibition of the Client's use of the Website and Services, and the Client is ordered to discontinue use immediately. Thereafter, the relationship between Client and Loveable Design shall cease and be of no further force and effect between the parties, except that any obligation of Client to pay Loveable Design for services rendered shall remain and continue to be an ongoing obligation owed by Client to Loveable Design.

1. Services Provided

Loveable Design provides fractional design services on a subscription basis. Services include, but are not limited to: product design (mobile and web applications); user experience (UX) design; user interface (UI) design; brand identity and logo design; graphic design; website design; pitch deck and presentation design; and related digital design services (collectively, "Design Services").

Design Services expressly DO NOT include: physical product design; mechanical or industrial design; complex animations; 3D modeling; video editing; hand-drawn custom illustrations; print production; manufacturing specifications; or any services not explicitly listed above. Loveable Design reserves the right to decline any request that falls outside the scope of Design Services or that, in its sole discretion, is not suitable for the subscription model.

2. Subscription Plans and Service Terms

Loveable Design offers subscription packages of varying durations (e.g., 1 month, 3 months, 6 months) as described on the Website at the time of purchase (each, a "Service Term"). The specific features, pricing, and terms of each subscription package are as set forth on the Website and may be modified by Loveable Design from time to time.

Each Service Term begins on the date payment is received in full ("Start Date") and ends at the conclusion of the purchased period. For example, a 3-month subscription purchased on January 1 will expire on March 31. Service Terms are fixed periods and do not automatically renew. Unused portions of a Service Term do not carry over, extend, or roll into any subsequent Service Term. Client is responsible for tracking the expiration of their Service Term.

3. Fair Use Policy

While subscriptions include access to design requests during the Service Term, all usage is subject to this Fair Use Policy. Client acknowledges and agrees that:

(a) One Active Request. Client may have only ONE (1) active design request in progress at any time. A new request will not be commenced until the current active request has been delivered and marked complete. Submitting multiple requests does not create parallel workflows.

(b) Sequential Processing. Requests are processed sequentially in the order received. Loveable Design is not obligated to work on multiple requests simultaneously.

(c) Reasonable Revisions. While revisions are included, revision requests must relate directly to the original design brief for that request. Revisions that constitute new projects, substantial scope changes, or complete redesigns may be treated as new requests. Loveable Design reserves the right, in its sole discretion, to determine whether a revision request is within scope.

(d) Good Faith Use. The subscription is intended for Client's own business use. Client shall not resell, sublicense, or provide Design Services to third parties. Client shall not use the subscription in any manner that Loveable Design determines, in its sole discretion, to be abusive, excessive, or inconsistent with the intended purpose of the subscription model.

(e) Consequences of Violation. Loveable Design reserves the right to suspend or terminate any subscription, without refund, if Client violates this Fair Use Policy. Loveable Design may also implement request limits or other restrictions if it determines, in its sole discretion, that Client's usage is unreasonable or abusive.

4. Request Submission and Turnaround

Design requests shall be submitted through the methods designated by Loveable Design, which may include a Figma design board, project management platform, or other communication channels specified by Loveable Design. Client is responsible for providing clear, complete briefs and all necessary materials, assets, and information required to complete the request.

Loveable Design targets a turnaround time of approximately one (1) week for standard requests; however, LOVEABLE DESIGN MAKES NO GUARANTEE OF SPECIFIC TURNAROUND TIMES. Actual turnaround will vary based on the complexity of the request, current workload, Client responsiveness, and other factors. Complex projects (such as full mobile application design, comprehensive brand identity systems, or multi-page websites) may require multiple weeks or multiple Service Terms to complete. Loveable Design shall not be liable for any damages arising from turnaround times.

5. Payment Terms

Full payment for the selected subscription package is due at the time of purchase. All payments are processed through Stripe or such other payment processor as Loveable Design may designate. The Service Term will not commence, and Loveable Design has no obligation to perform any Design Services, until payment has been received in full.
